Terms of Service

1. Acceptance of Terms
These Terms of Service (“Terms”) are a binding agreement between you and InspectSOP LLC(“InspectSOP”, “we”, “us”), which operates the InspectSOP platform (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not access or use the Service. These Terms apply to all users, including visitors, registered users, and paying customers. If you accept these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and “you” refers to that entity.
2. Description of Service
InspectSOP provides a software-as-a-service platform for professional home inspectors, including mobile inspection tools, report generation, AI-assisted narrative writing, client delivery, and business management features.
3. Platform Role
InspectSOP is a software platform. We are not a home inspection company, and we do not perform, supervise, review, or warrant inspections or inspection reports. The inspection firm using the Service is solely responsible for its inspections, the content and accuracy of its reports and other documents, its client relationships, and its compliance with the licensing laws, standards of practice, and record-keeping requirements that apply to it. InspectSOP does not issue, verify, or warrant professional licenses or credentials.
InspectSOP is not a party to any agreement between an inspection firm and its clients. Document templates made available through the Service (including pre-inspection agreement, report disclaimer, and scope of inspection starter text) are generic starting points, are not legal advice, and must be reviewed and adapted by the firm for the jurisdictions in which it operates.
4. Account Registration
You must create an account to use most features of the Service. You agree to provide accurate and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account, including activity by team members you invite. You must be at least 18 years old to create an account.
5. Subscription and Billing
InspectSOP offers paid subscription plans. Subscriptions are billed monthly or annually in advance. After your free trial (2 free inspections), you will be required to provide payment information to continue using the Service. We use Stripe to process payments. You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
We reserve the right to modify pricing with 30 days' prior notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
Cancellations take effect at the end of the current billing period. We do not offer prorated refunds or credits for unused time within a billing period.
6. Your Data
You retain ownership of all inspection data, reports, photos, and content you create using the Service (“Your Content”). You grant InspectSOP a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, and transmit Your Content solely as needed to provide, secure, and support the Service. This license ends when Your Content is deleted from the Service, except for archived report copies described below. You may export your data at any time from your account settings.
While your account is active, the photographs and PDF documents associated with a published report are retained and made available online for a minimum of seven (7) years from the report’s issue date. After that period, InspectSOP may remove the stored photographs and PDF files to manage storage while retaining the underlying report record. Any such removal is not automatic and is subject to InspectSOP’s internal review. InspectSOP does not guarantee that report media will remain available beyond this period; online access is provided as a convenience only and is not a system of record for your inspection files.
When you initiate account deletion, your data enters a 14-day grace period during which you can reactivate your account and restore full access. If you have an active subscription, the grace period begins after your current billing period ends. Once the grace period expires, all operational data is permanently deleted. Published report PDFs may be available in a read-only archive for up to 7 years following account deletion to support continued client access via original report links. InspectSOP does not guarantee the availability of archived reports and reserves the right to modify its data retention practices at any time.
State licensing boards impose their own recordkeeping requirements on inspectors, and those requirements vary by jurisdiction. You are solely responsible for determining and meeting your recordkeeping obligations, including downloading and retaining your own copies of your reports and associated media. The online copy hosted by InspectSOP is a convenience and is not a substitute for records you are required to maintain. When you initiate account deletion, the platform compiles a full PDF archive for you to download before deletion completes.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated tools to scrape or extract data from the Service
- Share your account credentials with unauthorized third parties
- Upload content that infringes third-party intellectual property rights
8. AI Features
InspectSOP uses third-party AI services (including OpenAI) to power narrative generation features. AI-generated content is provided as a draft and should be reviewed by the inspector before inclusion in a report. You are solely responsible for the accuracy of all content in reports delivered to clients. InspectSOP makes no warranty regarding the accuracy of AI-generated narratives.
9. Intellectual Property
The Service, including its software, design, and trademarks, is owned by InspectSOP and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes during your subscription. No rights are granted except as expressly stated in these Terms. If you send us feedback or suggestions about the Service, we may use them without restriction or obligation to you.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. INSPECTSOP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSPECTSOP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO INSPECTSOP IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless InspectSOP and its members, managers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your inspections, reports, and other services you provide to your clients; (b) Your Content, including documents generated or delivered through the Service; (c) your use of any document template made available through the Service; (d) your violation of these Terms; or (e) your violation of any law or the rights of a third party. We will provide you with prompt notice of any such claim and may, at our own expense, participate in the defense with counsel of our choosing.
13. Term, Termination, and Suspension
We may suspend or terminate your access to the Service if you materially breach these Terms, if your account payment is overdue, or if suspension is reasonably necessary to protect the Service or other users. Where practical, we will notify you and give you an opportunity to cure before termination. You may stop using the Service and cancel your subscription at any time. Sections of these Terms that by their nature should survive termination (including Sections 3, 6, 10 through 15, and 17) survive.
14. Dispute Resolution and Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of those courts.
ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM AROSE; OTHERWISE IT IS PERMANENTLY BARRED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH PARTY WAIVES ITS RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, AND CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY.
15. No Third-Party Beneficiaries
These Terms are for the benefit of you and InspectSOP only. No other person, including clients of inspection firms and other recipients or viewers of inspection reports, acquires any rights under these Terms or in connection with the Service.
16. Changes to Terms
We may update these Terms from time to time. We will post the revised Terms on this page with a new “Last updated” date. For material changes, we will notify registered users and ask you to accept the revised Terms in the app before you continue using the Service. Non-material changes take effect when posted.
17. General
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be enforced to the maximum extent permitted. These Terms, together with the acceptance statements you agree to in the app, are the entire agreement between you and InspectSOP regarding the Service. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. A failure to enforce a provision is not a waiver of it. Neither party is liable for delay or failure caused by events beyond its reasonable control.
